General Policies

    • Retainer Policy: A retainer fee is required to book services and secure your scheduled date. This amount aries based on service and will be credited toward the total cost of the

      project.

    • Payment Schedule: Final payment is due one week prior to the event date for weddings, all others are due day of the shoot upon arrival. If payment is not received by the due date, the shoot may be canceled, and the retainer will be forfeited.

    • Contract Requirement: All wedding and large project clients must sign a contract before any work commences. The contract outlines the agreed-upon services, payment terms, timeline, and other important details.

    • Contract Adjustments: Any changes to the original contract must be made in writing and agreed upon by both parties. Any additional services outside the original scope will be billed separately.

    • Client Delays: If the client or their team is late to the scheduled shoot, the session will still end at the originally scheduled time unless otherwise agreed upon in advance.

      Additional time may be available at the company’s discretion, subject to availability and a fee per additional hour.

    • Client Cancellations: If a client cancels the project, the retainer fee will be forfeited.

      Cancelations less than 90 days of weddings will still be responsible for the remaining balance by the scheduled final payment date.

    • Rescheduling: Reschedules require new retainer fee.

    • Company Cancellations: In the event of an emergency or unforeseen circumstances on the company’s side (e.g., illness, equipment failure), a full refund of the retainer will be issued, owner will assign a comparable team member to cover the shoot or the shoot will be rescheduled at the client’s convenience.

    • Ownership of Media: The media produced (photographs, videos, etc.) remain the property of Donzaleigh’s Photography until the full balance has been paid. Once payment is made, the client is granted the right to use the media for personal purposes. Any commercial use must be explicitly granted and may have an additional fee as outlined in the contract.

    • Usage of Media for Promotion: Donzaleigh’s Photography reserves the right to use the produced media for promotional purposes, including but not limited to websites, social media, and portfolios. If the client wishes to opt-out, a written request can be made.

    • Venue & Permits: Clients are responsible for securing any necessary permits or permissions for the shoot location, including but not limited to venue access and location fees.

    • Cooperation: The client is expected to provide reasonable cooperation, including timely access to the shoot location, required props, or talent, and any necessary approvals for creative direction.

    • Model/Property Releases: If applicable, the client is responsible for ensuring any models or property used in the shoot sign a release form allowing Donzaleigh’s Photography to use their likeness or image.

    • Raw Footage: Raw footage is available upon request, but additional fees may apply. It is not included in standard packages unless explicitly stated.

    • Delivery Timeline: Final deliverables (edited photos/videos) will be provided within estimated prior to the shoot. Delays caused by the client (e.g., delayed feedback or approvals) may extend the timeline.

    • Storage: Final media files will be delivered via online gallery or storage. Client may opt for USB drive in lieu of online gallery. The file storage period is one month. After this period, files may be deleted or require a retrieval fee.

    • Unforeseen Circumstances: Neither party will be held responsible for failure to perform due to circumstances beyond their control up to the agreed contract terms, such as natural disasters, government restrictions.

  • Privacy and Data Protection

    • Data Collection: General personal information such as name, contact details will be stored and used for occasional promotion and special events. Information will not be shared with any other organization or party.

    • Security: Donzaleigh’s Photography protects client data and complies with applicable privacy laws, including Tennessee's privacy regulations. Donzaleigh’s Photography is not responsible for any third-party payment processing issues and such errors will need to be resolved with the third party directly.

    Governing Law

    • Jurisdiction: The terms and conditions are governed by Tennessee state law and any legal disputes will be resolved in Tennessee courts if a third-party mediator is not applicable.

    9. Modifications to the Terms

    • Changes to Terms and Conditions: Donzaleigh’s Photography reserves the right to modify the T&Cs at any time and will notify users of changes through website update.
